Privacy policy for service providers

Your personal data will be processed by ROUTINEDISPLAY, Lda., legal person no. 515705950, with registered office at Praça Conde Agrolongo, no. 123 Edifício Gnration 4700-132 Braga, hereinafter "OSCAR". OSCAR is responsible for processing personal data within the meaning of the General Data Protection Regulation ("GDPR").

  1. What personal data do we process?

    1.1 Name, photograph, cell phone number, email address, business address or registered office, TIN or VAT number (depending on whether the Service Provider is a natural or legal person).
    1.2 Geographical location of the Service Provider.
    1.3 IP address of the device on which the OSCAR application is installed.
    1.4 Information related to any disputes and/or complaints.
    1.5 Efficiency levels and evaluation of the Service Provider.

  2. What are the purposes for processing personal data?

    We process your personal data for the following purposes:
    2.1 Service provision management: The processing of your data is necessary for the performance of the service contract to be concluded between you and OSCAR.
    2.2 Complaints management: OSCAR may notify you in the course of a poor evaluation of the provision of services. OSCAR collects the information and details arising from the provision of services in order to analyze and resolve the situation underlying the complaint and/or dispute resolution.
    2.3 Invoicing: OSCAR processes personal data (applicable in the case of natural persons) for the purposes of invoicing and payment for the services provided.
    2.4 Compliance with legal obligations: In compliance with legal obligations, your personal data may also be transmitted to third parties for their own purposes, such as judicial, administrative, supervisory or regulatory authorities.

  3. What is the legal basis for processing personal data?

    3.1 The Service Provider's personal data will be processed for the fulfillment and performance of the service agreement entered into with OSCAR. The Service Provider must activate the geolocation services on their mobile device, activation being a necessary condition to allow the execution of services through the OSCAR app to users.
    3.2 OSCAR processes evaluation data and compliance with the provision of services requested in pursuit of its legitimate interests.
    3.3 OSCAR may process your personal data to ensure and guarantee compliance with legal obligations to which it is subject under the legislation of a Member State and/or the European Union.

  4. Will your information be shared with third parties?

    4.1 Your personal information will be shared with OSCAR Users. In this case, Users will have access to your first name and geographical location.
    4.2 Any personal data of service providers is stored on the OSCAR server, which is located on the territory of a Member State of the European Union. Only authorized employees of ROUTINEDISPLAY, Lda. may have access to personal data for the purpose of managing the provision of services and for managing any claims or disputes related to the provision of services.
    4.3 Your personal data may be shared with other responsible parties and/or third parties for the fulfillment of legal and/or contractual obligations, such as judicial, administrative, supervisory or regulatory authorities.
    4.4 Your personal data will only be processed within the European Union.

  5. What are your rights?

    Your requests will be treated with special care so that we can ensure the effectiveness of your rights. You may be asked to provide proof of your identity so that we can ensure that personal data is only shared with you. You can ask us at any time:
    5.1 Access and rectification: You can change your data through the application. If this functionality is temporarily unavailable, please contact us at info@oscar-app.com.
    5.2 Deletion of personal data: you can request the deletion and/or destruction of your personal data. However, please note that this request will result in the cancellation of your OSCAR Service Provider profile. In addition, you should bear in mind that OSCAR will have to store your personal data until the expiry of the legal time limits described below.
    5.3 Portability: you have the right to receive the personal data concerning you that you have provided to OSCAR in a structured, commonly used and machine-readable format. You should send your requests to the following email address: info@oscar-app.com. Your requests will be answered within one month, and we will specify the date or period in which the data will be deleted or transferred.

  6. How long do we store your personal data?

    6.1 Your personal data will be stored for as long as your OSCAR Service Provider profile is active or one year after the termination of the service agreement with OSCAR.
    6.2 Financial data is stored for seven years from the date of the last service requested through the OSCAR app.
    6.3 Tax and accounting data will be stored for ten years from the last service invoice.
    6.4 In the event that there are indications that a crime has been committed or false information has been provided, the data will be stored for ten years.
    6.5 Data on the history of services and corresponding evaluations will be stored for three years, after which time the data will be anonymized.
    6.6 In the event of pending litigation or legal proceedings, the data will be kept until it has become final.

  7. Processing of personal data of OSCAR app users:

    It is forbidden to process Users' personal data without OSCAR's permission. The Service Provider may not contact Users directly, nor may it collect or request their personal data from them, promote or misuse or promote the cross-referencing of personal data provided by Users. If any of the provisions of this User Privacy Policy and the Terms & Conditions of the service providers are violated, OSCAR reserves the right to cancel your app account and demand compensation for any damages caused by your conduct.
