Your personal data will be processed by OSCAR App Limited, company number 16336226, with registered address at 3rd Floor, 1 Ashley Road, Altrincham, Cheshire WA14 2DT, hereinafter referred to as “OSCAR”, or “we”, which operates its services through the website https://www.oscar-app.com/uk and the mobile application OSCAR, available on the App Store and Google Play (hereinafter the “application” or “OSCAR application”). OSCAR is the controller of personal data under the UK General Data Protection Regulation (“UK GDPR”) and the Data Protection Act 2018, insofar as, in the course of its business activities, it may collect and process data from the Service Provider (“Service Provider”) for its own processing activities. Personal data means any information of any nature, regardless of the medium, including sound and image, relating to an identified or identifiable natural person (“Data Subject” or, in this specific case, “Service Provider”). An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
1.1 The personal data collected and processed by OSCAR includes name, photograph, mobile phone number, email address, professional or business address, National Insurance Number (or Company Registration Number, if the Service Provider is a legal entity). 1.2 The personal data collected and processed by OSCAR may also include the Service Provider’s geographic location, the IP address of the device on which the OSCAR application is installed, the Service Provider’s performance levels and ratings, and information related to potential disputes and/or complaints. 1.3 Geographic location and geolocation data are a necessary condition to allow the provision of services through the OSCAR application. Such data are collected from the moment a service is requested until its completion, or when the application is running in the foreground. 1.4 OSCAR may also collect your personal data through cookies and other tracking technologies. The use of cookies by OSCAR is regulated in our Cookie Policy.
We process your personal data for the following purposes: 2.1 Service provision management: The processing of your data is necessary for the performance of the service contract to be concluded between you and OSCAR, to match you with certain users and services, to manage the scheduling of tasks, and to process payments. All such processing is necessary for the effective provision of the requested services, including, in particular, the required sharing with OSCAR users. The applicable legal bases may be performance of the contract, pursuit of legitimate interests (our own or those of third parties), and your consent. Please note that where personal data are necessary for the performance of the contract, failure to provide such data may prevent the provision of services. 2.2 Monitoring and quality assurance: We may contact you at any time to assess reasons for dissatisfaction regarding the services provided. In particular, OSCAR may notify you in the event of poor ratings from users, while maintaining user anonymity. OSCAR collects information and details arising from the provision of services in order to analyse and resolve complaints and/or disputes. The legal basis for this processing is performance of the existing contract between you and OSCAR. 2.3 Compliance with legal obligations: In the context of the relationship with OSCAR, there may be processing of personal data aimed at complying with legal obligations (including tax, accounting, reporting and communication) which may involve disclosure of data to third parties such as judicial, administrative, supervisory or regulatory authorities. The applicable legal basis in such cases will be compliance with legal obligations. Where personal data are required to comply with legal obligations, failure to provide such data may prevent the service from being delivered. 2.4 Complaints and disputes management: We may process your data to analyse and resolve any complaints about services provided, or for other disputes. The legal bases for this processing are compliance with legal obligations and OSCAR’s legitimate interests. 2.5 Security and fraud prevention: We use data to help maintain the security, protection and integrity of our services and Service Providers. For this purpose, we verify accounts, identity, or compliance of Service Providers with security requirements to prevent fraud related to use of the OSCAR application. The legal basis for this processing is OSCAR’s legitimate interests. 2.6 Customer support: OSCAR uses the Service Provider’s personal data, such as their name, to provide support to OSCAR users in issues they raise. The legal basis for this processing is OSCAR’s legitimate interests. 2.7 Standardisation and moderation of profile photographs: OSCAR may modify, optimise or adjust the profile photographs of Service Providers, including by using artificial intelligence technologies, in order to ensure the standardisation, consistency and suitability of the image displayed in the OSCAR application. This processing is carried out in an automated and supervised manner, exclusively to ensure that images meet minimum requirements of quality, legibility and compliance with the Terms & Conditions. The legal basis for this processing is OSCAR’s legitimate interest in maintaining the integrity, trust and security of the platform, as well as providing a uniform and professional experience for users.
3.1 Some of your personal data, specifically your first name and geographic location, will be shared with OSCAR users. 3.2 In the context of processing Service Provider data, OSCAR engages third-party entities, acting as subcontractors, to provide support services to its business, with whom your data may be shared. 3.3 OSCAR undertakes to subcontract only entities that provide sufficient guarantees of implementing appropriate technical and organisational measures, and that act in strict compliance with the UK GDPR, the Data Protection Act 2018, and this Privacy Policy. 3.4 No subcontractor may transfer data to other entities without OSCAR’s prior written authorisation, nor may they subcontract other entities without OSCAR’s prior authorisation. 3.5 Personal data of Service Providers are stored on servers controlled by OSCAR, located within the United Kingdom or another state within the European Economic Area (EEA). Only authorised OSCAR staff may access such data for service management or dispute resolution purposes. 3.6 Your personal data may also be shared with other controllers and/or third parties for compliance with legal and/or contractual obligations, such as payment processors, insurers, or judicial, administrative, supervisory or regulatory authorities. 3.7 In principle, your personal data will be processed only within the United Kingdom and the EEA. Where transfers outside the UK or EEA are necessary (e.g., use of certain IT service providers), OSCAR will implement the necessary measures to ensure compliance with applicable law, including the use of the UK International Data Transfer Agreement (IDTA) or other recognised safeguards.
4.1 OSCAR undertakes to ensure that personal data are: (i) processed lawfully, fairly and transparently; (ii) collected for specified, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes; (iii) adequate, relevant and limited to what is necessary in relation to the purposes; (iv) accurate and kept up to date, with measures to erase or rectify inaccuracies without delay; (v) kept for no longer than is necessary for the purposes; (vi) processed securely, including protection against unauthorised or unlawful processing, accidental loss, destruction or damage, with appropriate technical and organisational measures. 4.2 OSCAR ensures that data processing is only carried out under these conditions and in compliance with these principles.
You may exercise the following rights at any time. Proof of identity may be required. 5.1 Access: Confirmation of whether your personal data are being processed and access to such data. 5.2 Rectification: Right to have inaccurate or incomplete data corrected. This may be done directly through the application where available, or by contacting us at [email protected]. 5.3 Withdrawal of consent: Where consent is the legal basis for processing, you may withdraw it at any time, without affecting the lawfulness of processing prior to withdrawal or processing based on other legal grounds (e.g., compliance with legal obligations, dispute resolution, fraud prevention). 5.4 Erasure: Right to request deletion of your personal data, except where legally required to retain them. Uninstalling the OSCAR application does not delete your data. Account cancellation must be requested to ensure deletion. 5.5 Restriction of processing: You may request restriction when (a) you contest the accuracy of the data; (b) processing is unlawful and you request restriction instead of erasure; (c) OSCAR no longer needs the data for the original purpose but you require them for legal claims; (d) you have objected to processing, pending verification of whether OSCAR’s legitimate grounds override yours. 5.6 Data portability: In certain circumstances, you have the right to receive personal data you have provided in a structured, commonly used, machine-readable format. 5.7 Objection: You may object to processing where it is based on legitimate interests or public interest, including for direct marketing purposes. For marketing communications, you may object directly by using the “unsubscribe” link included in each message. 5.8 Exercising your rights and timelines: email [email protected]. OSCAR will respond without undue delay, within one month of receipt of the request, extendable by two months depending on complexity and volume.
6.1 While your OSCAR account remains active and for one year after deactivation. 6.2 Financial and tax records necessary to comply with legal obligations will be retained for ten years from the date of the last service provided. 6.3 In cases of suspected crime or provision of false information, data will be retained until the limitation period for legal actions. 6.4 Service history and related ratings will be retained for three years, after which the data will be anonymised. 6.5 In case of ongoing litigation or judicial proceedings, data will be retained until a final binding judgment. 6.6 Call recordings will be retained for up to 30 days (for quality monitoring) or up to 24 months (when required for proof of commercial transactions). 6.7 Security monitoring outputs will be deleted immediately.
It is prohibited for the Service Provider to process users’ personal data without OSCAR’s authorisation. The Service Provider may not contact users directly, request or misuse their personal data, or cross-use such data. Breach of these rules may lead to account cancellation and a claim for damages.
8.1 To guarantee security and confidentiality of Service Provider data, OSCAR processes information in strict confidence, in accordance with internal security and confidentiality policies and procedures, updated as required. 8.2 Taking into account the nature, scope, context and purposes of processing, as well as the risks to the rights and freedoms of Data Subjects, OSCAR will apply appropriate technical and organisational measures to ensure data protection and compliance with legal requirements. 8.3 OSCAR also undertakes to ensure that, by default, only personal data necessary for each specific purpose are processed, and that such data are not made accessible to an indefinite number of people without human intervention.
9.1 In the event of a personal data breach likely to result in a high risk to the rights and freedoms of Data Subjects, OSCAR will notify the Information Commissioner’s Office (ICO) without undue delay and within 72 hours of becoming aware of the incident. 9.2 OSCAR will also notify the Service Provider where the breach is likely to result in a high risk to their rights and freedoms, except where: (i) OSCAR has applied appropriate protection measures (e.g., encryption) making the data unintelligible; (ii) OSCAR has taken subsequent measures ensuring that the high risk is no longer likely to materialise; (iii) notification would involve disproportionate effort, in which case OSCAR will make a public communication.
