Terms and Conditions for Service Providers

OSCAR presents to you these General Terms & Conditions regarding the provision of services, as well as the information, elements, data, and requirements contained herein, which are the property of OSCAR APP LIMITED (company no. 16336226), with registered office at 3rd Floor, 1 Ashley Road, Altrincham, Cheshire WA14 2DT, hereinafter referred to as "OSCAR".

  • 1. About the OSCAR Application
    For the purposes of understanding these Terms & Conditions, the following definitions apply:
    1.1 "OSCAR Application" (hereinafter "OSCAR" or "OSCAR app"): the software that provides a set of services and allows their electronic and remote contracting.
    1.2 "Terms & Conditions": the general conditions that govern access to and use of the OSCAR app by its Users.
    1.3 "Personal Data": information relating to an identified or identifiable natural person ("data subject"), as defined under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
    1.4 "Service Provider": a self-employed individual or incorporated business with whom OSCAR has a commercial agreement under which services are made available on the App, and who will provide services directly to the User.
    1.5 "Provision of Services": the services made available in the OSCAR app and the contract entered into between the Service Providers and the Users.
    1.6 "User": a natural person, over 18 years old, who accesses and uses the Application in accordance with these Terms & Conditions.
    1.7 "Contract": the commercial agreement concluded between the Service Provider and OSCAR, which includes: 1.7.1 these general Terms & Conditions; 1.7.2 special terms published in the OSCAR app, such as prices or service descriptions; 1.7.3 additional Terms & Conditions or documents that may be signed in the future between the Service Provider and OSCAR.
    1.8 "Price": the amount the User must pay for the services provided, including the amount to be withheld for payment of OSCAR’s intermediation fee.
    1.9 "Intermediation Fee": the fee that the Service Provider is obliged to pay OSCAR for use of the platform.
    1.10 "Payments": card, payment system, and other means of payment chosen by Users through OSCAR to pay for the Provision of Services.
  • 2. Acceptance and Conclusion of the Contract with OSCAR
    2.1 To access the OSCAR app, the Service Provider must install the application on a mobile device (smartphone or tablet, with iOS or Android).
    2.2 Downloading and installing the OSCAR app is free of charge, although network or mobile data charges may apply and are the sole responsibility of the Service Provider.
    2.3 After account creation, authentication is carried out via SMS or email with a personal, confidential, and non-transferable code. The Service Provider must maintain its confidentiality and security. OSCAR may introduce additional verification methods such as multi-factor authentication.
    2.4 The Service Provider must keep credentials confidential and limit access to their account, protecting them from loss, theft, or misuse. Any loss must be promptly reported to OSCAR.
    2.5 The Service Provider is solely responsible for any damage resulting from unauthorised use of their credentials.
    2.6 The Service Provider declares and guarantees that they: 2.6.1 have read, understood, and agree to be bound by this Contract and all obligations arising from it; 2.6.2 will not authorise others to use their account, nor transfer or assign it without OSCAR’s written consent; 2.6.3 will not copy or distribute OSCAR’s software or content without OSCAR’s prior written permission.
    2.7 In the event of a breach of applicable law, these Terms & Conditions, or any contractual provisions, OSCAR reserves the right to suspend or delete the Service Provider’s account, temporarily or permanently, at its sole discretion.
  • 3. Contractual Relationship between the Service Provider and the User
    3.1 The Service Provider acknowledges that they are entering into a direct Service Provision Contract with the User.
    3.2 The Services are performed by the Service Provider as an independent contractor, not as an employee, worker, or agent of OSCAR. Nothing in this Contract creates an employment or agency relationship between OSCAR and the Service Provider.
    3.3 Without prejudice to OSCAR not being a party to the contractual relationship between the Service Provider and the User, the Service Provider undertakes to: 3.3.1 hold appropriate public liability insurance covering their professional activities and provide proof to OSCAR upon request; 3.3.2 comply with the Health and Safety at Work Act 1974 and all relevant UK regulations regarding safety and hygiene during service performance; 3.3.3 ensure that they and any assistants are fit to perform services safely and competently; 3.3.4 not provide services under the influence of alcohol, drugs, or any condition that may endanger the User or third parties; 3.3.5 act diligently and professionally at all times; 3.3.6 use their own tools, materials, and means of transport, with all such expenses (including fuel and consumables) being the sole responsibility of the Service Provider.
  • 4. Prices
    4.1 The price of each service is determined within the OSCAR app and displayed prior to confirmation. The Service Provider will also be able to view the applicable intermediation fee percentage retained by OSCAR.
    4.2 The OSCAR app allows Users to extend services based on an hourly rate. The User may choose whether to continue the service or not.
    4.3 If the User does not accept a new price, the service will be cancelled, and any applicable cancellation fees will apply in accordance with the app’s internal policies.
  • 5. Payment Methods
    5.1 The Service Provider must provide valid and complete bank details (IBAN or UK bank account) for receiving payments.
    5.2 Payments are typically processed daily and may take up to 7 business days to appear in the Service Provider’s account.
    5.3 Payments are handled through an independent third-party payment provider (Stripe Payments UK Ltd., authorised by the Financial Conduct Authority).
    5.4 OSCAR will issue an electronic invoice for the intermediation fee and send it by email after confirmation that the service has been successfully completed.
  • 6. User Identification
    6.1 Before performing any service, the Service Provider must attend the address indicated and verify the User’s identity.
    6.2 If a service is performed for the wrong User due to identification errors, OSCAR will refund the User and withhold payment from the Service Provider, who shall bear the refund cost.
  • 7. Liability
    7.1 OSCAR is not a party to the contract between the User and the Service Provider and bears no responsibility for performance, timing, or quality of services.
    7.2 The Service Provider acknowledges that OSCAR may be required to cooperate with authorities or users in dispute resolution, but any liability for the service rests solely with the Service Provider.
    7.3 If OSCAR is held liable to a User due to the Service Provider’s conduct, OSCAR has the right to recover all related losses, costs, or damages from the Service Provider.
    7.4 The Service Provider agrees to indemnify OSCAR against any claim, loss, or damage arising from their negligence, misconduct, or breach of contract.
    7.5 OSCAR does not guarantee uninterrupted operation of the app and cannot be held liable for downtime, delays, viruses, or technical issues beyond its control.
    7.6 The Service Provider is fully responsible for their actions and omissions, including illegal or negligent use of the OSCAR app.
    7.7 The Service Provider agrees that digital records and transaction logs may serve as evidence in any dispute or legal proceeding.
    7.8 Under the service warranty, the client has the right to request a service rectification within a maximum period of fifteen (15) days after the completion of the service. Accordingly, the Service Provider is obliged to return to the service location, at no additional cost to the Client, in order to assess, correct, or complement any identified deficiencies.
    7.9 For services considered specialized, it is mandatory to present valid certificates and licenses corresponding to the activity performed, namely Gas, HVAC, or other equivalents required by applicable law.
    The Service Provider is responsible for ensuring that they possess and present these certifications whenever requested by OSCAR or the Client.
  • 8. Penalties
    OSCAR reserves the right to suspend or remove any Service Provider who: 8.1 violates or is suspected of violating these Terms & Conditions or the applicable Privacy Policy; 8.2 uses false, inaccurate, or incomplete registration data; 8.3 engages in fraudulent or unethical conduct; 8.4 attempts to manipulate, modify, or interfere with OSCAR’s systems; 8.5 directly contacts Users outside the OSCAR platform for business purposes; 8.6 has engaged in prior misconduct affecting OSCAR’s reputation or credibility.
  • 9. Intellectual Property Rights
    9.1 The Service Provider acknowledges that all intellectual property rights in the OSCAR app (including content, design, logo, and software) belong to OSCAR or its licensors.
    9.2 No part of the OSCAR app may be copied, rented, or sold without OSCAR’s written consent.
    9.3 The Service Provider may not access, reproduce, distribute, or modify any OSCAR materials.
    9.4 OSCAR grants a non-exclusive, revocable, and non-transferable licence to use the app for commercial purposes in accordance with these Terms & Conditions.
    9.5 OSCAR may edit or optimise Service Provider profile photos using AI solely to maintain visual standards and professionalism without altering identity, as detailed in the Privacy Policy.
  • 10. User Ratings
    10.1 OSCAR relies on User feedback to ensure quality and reliability.
    10.2 After each service, Users may rate the Service Provider on a scale of 1 to 5.
    10.3 Service Providers with an average rating below 4.5 may be placed in a performance review programme aimed at improving quality.
    10.4 If the next five rated services do not raise the average to at least 4.6, OSCAR may temporarily or permanently suspend the Service Provider’s account.
    10.5 OSCAR may terminate the contract immediately or with reasonable notice for repeated low ratings, serious misconduct, safety breaches, fraud, or reputational harm to OSCAR.
  • 11. Term and Termination
    11.1 The Service Provider may terminate this Contract at any time by giving at least 15 days’ written notice to OSCAR.
    11.2 OSCAR may terminate the Contract at any time for a justified reason or breach of these Terms, with or without notice, at its discretion.
    11.3 Upon termination, all rights granted to the Service Provider under this Contract cease immediately, and the Service Provider must discontinue all use of the app.
  • 12. Dispute Resolution
    12.1 In case of disputes regarding services or payments, Service Providers should first contact [email protected].
    12.2 OSCAR acts as the single point of contact for relevant UK authorities and Service Providers.
    12.3 If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  • 13. Final and Transitional Provisions
    13.1 OSCAR reserves the right to modify the app’s presentation or configuration at any time.
    13.2 OSCAR may update these Terms periodically; Service Providers are advised to review them regularly.
    13.3 Updates may be required due to new app features or legal requirements.
    13.4 OSCAR will make reasonable efforts to notify Service Providers of major updates at least 15 days in advance.
    13.5 If any provision of these Terms is deemed invalid, the remaining provisions remain in full effect.
  • 14. Governing Law and Jurisdiction
    14.1 The OSCAR app and these Terms & Conditions are governed by the laws of England and Wales.
    14.2 OSCAR and the Service Provider agree that any disputes shall be resolved exclusively by the courts of England and Wales.
    14.3 Without prejudice to these rights, OSCAR is open to voluntary mediation or alternative dispute resolution (ADR) in the United Kingdom whenever proportionate and appropriate.
