We present to you the General Terms & Conditions of use of the OSCAR application, information, elements, data and requirements contained therein and which is the property of OSCAR APP LIMITED (company no. 16336226), with registered office at 3rd Floor, 1 Ashley Road, Altrincham, Cheshire WA14 2DT, hereinafter referred to as "the OSCAR", "application", "OSCAR application", "us" and "we".
- 1. About the OSCAR app - The OSCAR application has been developed as a platform that provides various services and solutions, and Users may request the Services they require through this means. For the purposes of understanding these Terms & Conditions, the following definitions shall apply:
1.1 "OSCAR application (hereinafter 'application' or 'OSCAR application')": the software that provides a set of services and allows them to be contracted electronically and remotely.
1.2 "Terms & Conditions": the general conditions that determine access to and use of the application by its Users.
1.3 "Personal Data": information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, by reference to identifiers such as a name, identification number, or location data (see Privacy Policy).
1.4 "Service Provider": a legal or natural person with whom OSCAR has a commercial agreement under which it makes its services available on the App, who will directly provide services to the User.
1.5 "Provision of Services": the services made available in the App and provided directly by the Providers to the Users.
1.6 "User": a natural person over the age of 18 who accesses and uses the OSCAR App in accordance with these Terms & Conditions. 
- 2. Accessing and Using the OSCAR app - 2.1 To access the OSCAR application, the User must install the application on their mobile device (smartphone or tablet, with iOS or Android).
2.2 Downloading and installing the OSCAR application is free of charge, although the User is responsible for any mobile data or network charges.
2.3 Access to the OSCAR application requires prior registration and creation of a User account, using accurate and complete information.
2.4 Registration requires full acceptance of these Terms & Conditions and the Privacy Policy.
2.5 The contract between OSCAR and the User regarding the use of the application takes effect once the User authenticates their account.
2.6 The User may, at any time, view, modify or delete their account information.
2.7 If the User breaches applicable law or these Terms & Conditions, OSCAR reserves the right to suspend or delete the User’s account.
2.8 The User must protect their credentials and limit access to their account.
2.9 Any damage resulting from unauthorised use of credentials is the sole responsibility of the User. 
- 3. Conditions for Service Provision - 3.1 The OSCAR application provides Users with access to various services. OSCAR does not provide these services directly and assumes no responsibility for their execution, quality, or timing. Services are provided by independent Service Providers.
3.2 To request a Service, the User must access the OSCAR app, select the desired service, and complete the relevant form. Once the price is displayed and accepted, the User confirms by authorising payment, and OSCAR confirms the booking.
3.3 The contract for the provision of services is formed directly between the User and the Service Provider at the moment of confirmation.
3.4 The User may cancel the requested Service under the following conditions:
3.4.1 If cancelled within 15 minutes, no fee will apply, and any hold on the User’s card will be released (refunds may take up to 10 working days).
3.4.2 If cancelled more than 15 minutes after booking, a cancellation fee of 30% or 100% of the service price may apply depending on proximity to the service time.
3.5 These rules comply with the Consumer Rights Act 2015, under which scheduled services performed at a specific date and time are exempt from the standard 14-day right to cancel.
3.6 OSCAR may also cancel any request before a service begins, releasing any held funds. Refunds may take up to 10 working days.
3.7 After service completion, the User may rate the Service Provider, and feedback may be used to monitor quality. 
- 4. Payment methods - 4.1 Users must provide valid, up-to-date payment details.
4.2 Payments are securely processed through our payment partner, Stripe.
4.3 If OSCAR cannot process a payment, access to the app may be temporarily suspended.
4.4 Prices include VAT where applicable.
4.5 OSCAR acts as a platform connecting Users and independent Service Providers and manages appointment scheduling and payments. Service Providers are solely responsible for tax and legal obligations. 
- 5. Prices - 5.1 Prices are shown before the User confirms the service request.
5.2 The User authorises OSCAR to charge the indicated amount after service completion.
5.3 If the Service Provider finds discrepancies between the service description and actual conditions, OSCAR may:
Adjust the price based on new conditions (subject to User approval); or
Cancel the service if execution is impossible.
5.4 If the User rejects a new price, a cancellation fee of 50% of the service value may apply.
5.5 Payments are processed by an independent third party holding the value before completion. 
- 6. Promo Codes - 6.1 OSCAR may issue promotional codes from time to time. Credits or benefits associated with such codes may be used as described in the relevant promotion.
6.2 OSCAR reserves the right to cancel promotional codes at any time, including where misuse or error is detected. 
- 7. Responsibility - 7.1 OSCAR is not a party to the service contract between User and Service Provider.
7.2 OSCAR is not liable for the performance of services or for indirect, incidental, or consequential losses.
7.3 OSCAR does not guarantee uninterrupted access to the application and is not responsible for technical failures, delays, or losses caused by third-party systems.
7.4 Users are responsible for their actions when using the application.
7.5 OSCAR cannot be held responsible for unauthorised use of a User’s account or credentials.
7.6 Computer records or their reproduction on any medium constitute valid evidence of operations performed through the OSCAR app. 
- 8. User Exclusion (Penalties) - We reserve the right to exclude from the app, immediately and without prior notice, any User who:
Violates or is suspected of violating these Terms & Conditions.
Provides false or incomplete registration information.
Makes fraudulent use of the application.
Attempts to manipulate, modify, or disrupt data or systems associated with the application. 
- 9. Intellectual Property Rights - 9.1 By using the OSCAR app, the User acknowledges that all intellectual property rights — including content, software, design, logos, and images — belong to OSCAR or its licensors.
9.2 No part of the OSCAR app may be reproduced or distributed without prior written consent.
9.3 All trademarks and distinctive signs of the OSCAR app are protected and may not be used without prior permission. 
- 10. Apple’s App Store and OSCAR - If the User downloaded the OSCAR app from Apple’s App Store:
The Terms & Conditions bind the User and OSCAR but not Apple.
Apple is only a provider of the App Store.
OSCAR is solely responsible for the app’s content and support.
Apple bears no responsibility for its use or performance. 
- 11. Google Play Store and OSCAR - If the User downloaded the OSCAR app from Google Play:
The Terms & Conditions bind the User and OSCAR but not Google.
Google is only a provider of the Play Store.
OSCAR is solely responsible for the app’s content and support.
Google bears no responsibility for its use or performance. 
- 12. Dispute Resolution - 12.1 In case of any dispute related to service provision, Users should first contact us at  [email protected]- .
12.2 If a dispute cannot be resolved informally, it will be subject to the jurisdiction of the courts of England and Wales. 
- 13. Final and Transitional Provisions - 13.1 OSCAR reserves the right to modify the app’s presentation, configuration, or content at any time without prior notice.
13.2 OSCAR may update these Terms periodically. Users should review them regularly.
13.3 Changes may reflect new features or legal requirements.
13.4 OSCAR will make reasonable efforts to notify Users of significant changes.
13.5 If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force.
